TERMS & CONDITIONS OF SALE

Welcome to our website. Young Art provide access to the www.youngart.se website and sell our products to you, subject to the conditions set out on this page.

Please carefully read these conditions before using the Website. By using the Website, you agree to be bound by these terms and conditions.

Young Art only sells products online to individuals who can purchase with PayPal or by invoice. If you are under 16, you may use the Website only with the involvement of a parent or guardian. Please note that upon placing an order, a receipt is automatically mailed confirming the order intent. This receipt does not constitute a contract, and orders may be cancelled at any time due to insufficient stock, inability to authorize a payment, suspicion of fraudulent intent, discovery of an incorrect item price, or any other reason, as we see fit. Please further note that Young Art shall have the right to refuse or cancel any such orders whether or not your payment has been made. If your payment has already been made and your order is cancelled, Young Art shall issue a credit to you. Young Art reserves the right to refuse access to the Website, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

GENERAL INFORMATION

Young Art ship worldwide. On all orders that are sent within the EU 25% VAT is added, and this applies to the cost of the ordered products and additional costs like shipping and insurance fees. This does not apply to non EU residents!

Young Art sales are commissioned for each artist. The artist is therefor the salesperson towards the buyer. Young Art pay according to Swedish law F-tax (25% VAT) and is registered in Sweden.

Swedish Art Tax

According to Swedish law an artist has no obligation to pay tax if sales is less than 336 000 SEK/year. If sales are more than 336 000 SEK/year 12% VAT is added to sales.

The only available methods of payment are those listed below. Young Art can not be held responsible for cash, stamps, checks, or other similar means of payment sent though the mail.

SHIPPING

After your payment has been registered it generally takes 3-6 business days for your order to be sent, and after that usually 1-2 days for the parcel to reach you if sent within Sweden, and about 3-8 days if you live in the rest of the world, the time depending on what country you live in.

All shipments are sent with the Swedish Mail.

PAYMENT

You can choose between the following payment methods:

Invoice

Payment is made in advance to Young Arts’ bank account. It usually takes 2-3 days for payment to be registered. It is important that you supply us with your order or invoice number in the message field when making the payment, otherwise it is difficult to see which order is payed for. If payment is not registered within 10 days after the order has been placed the order is canceled.

Paypal

Payment in advance to our Paypal account. The payment is registered immediately. It is also possible to transfer funds from you bank account to your paypal account.

RETURNS

In accordance with Swedish law you can return your order 14 days after arrival. If the individual product is in any kind of packaging this has to be unopened. When returning products according to this paragraph the full product price is refunded, but the customer pays all shipping costs.

DAMAGED ARTICLES

Every article is controlled before it is sent. If anything is damaged upon arrival, and it is obvious it did not occur in the shipping process, or if you receive other goods than what you ordered, Young Art will of course replace the product(s) without charge. If this is not possible, for example if it concerns a unique piece the costs will instead be refunded. However, it is important that you correctly report damages. Visible damages should be reported immediately upon receiving the parcel. Hidden damages should be reported withing 3 days after receiving the products.

Always email to hello@youngart.se before you return anything as damaged.

Please note that customs or tax fees, payed by the buyer upon recieving the order, will not be refunded.

CANCELLING AN ORDER

Your order can be cancelled free of charge as long as it has not been dispatched. If it has been dispatched you have to use your return right.

PRIVACY

According to Swedish law we must ask you to agree to that we store your personal data. Young Art is responsible for all data from our customers that we take part of. Such information will be used solely for the purpose to fulfill our commitments to you as a customer.

You have the right to, on demand, take part of any of your personal information stored in our database. If those should be incorrect, incomplete or irrelevant you have the right to demand correction or deletion of those data.

When placing an order the customer IP-address and Internat Service Provider (ISP) are registered. This is done to prevent fraud and sabotage.

Young Art is committed to protecting your privacy. Young Art guarantees the information you enter will not be disclosed to any outside organization or third party. Young Art will never put your personal data at the disposal of a third party for advertising purposes.

WHAT WE ASK FROM YOU

You must not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged or impaired.

You must not use the Website:

For criminal or fraudulent purposes, or in connection with other unlawful activity.

To send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trade mark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of, or contains, software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any ‘spam’.

COPYRIGHT, LEGAL STATEMENT AND DATABASE RIGHTS

All content and compilation of such content included on the Website, such as text, graphics, logos, button icons, images and software is the property of Young Art or its content suppliers and is protected by Swedish, European and International copyright and database right laws.

All software used on this Website is the property of Young Art, or our software suppliers and is protected by UK, European and International copyright laws.

You may not extract and/or re-utilize parts of the contents of the Website. In particular, you may not utilize any data mining, robots, or similar data gathering and extraction tools to extract (either once or many times) for re-utilization of any substantial parts of this Website. You also may not create and/or publish your own database that features substantial (e.g. our prices and product listings) parts of this Website.

All images and the design of the website are the property of Young Art. However, please feel free to use any of the pictures on display on the website, as long as the source is accounted for.

DISCLAIMER AND LIMITATION OF LIABILITY

This Website is provided by Young Art “as is” and “as available”. Young Art makes no representations or warranties of any kind, express or implied, as to the operation of this Website or the information, content, materials, or products included on this Website. It is expressly agreed by you that your use of this Website is at your sole risk.

Young Art disclaims all warranties, express or implied, including, but not limited to, implied warranties of salability and fitness for purpose to the fullest extent permissible by applicable law. Young Art does not warrant that this Website, its servers or e-mail sent from the Website are free of viruses or other harmful components. Young Art will not be liable for any damages of any kind arising from the use of this Website, including, but not limited to direct, indirect, incidental, punitive and consequential damages.

We reserve the right to make changes to our Website, policies, and these Terms and Conditions at any time. Your usage of the Website and your orders will be subject to the policies and Terms and Conditions in force at the time that you use the Website or that you order products from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of the remaining conditions.
GOVERNING LAW AND JURISDICTION

Your use of the Website, any purchase by you on the Website of any products and these conditions will be governed by and construed in accordance with the laws of Sweden. You agree, as we do, to submit to the non-exclusive jurisdiction of the Swedish courts.

Your statutory rights are not affected by these terms and conditions.

ABUSE

Any attempts on fraud or sabotage will be reported to the concerned authorities. Young Art has the right to cancel an order if such abuse is suspected. We store IP-numbers.
